Shade is an iOS application that provides:
You must be at least 16 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

You retain all rights to any content and settings you create within the App. By using the App, you grant us a license to store and process your data as described in our Privacy Policy. You agree to provide accurate information during onboarding and to keep it up to date.
Certain features require a paid subscription ("Shade Plus"). Subscriptions are sold and processed through Apple's App Store and are subject to Apple's terms and conditions.
We may offer a free trial for Shade Plus. Unless you cancel before the trial ends, you will be charged when it expires. We may modify or cancel trial offers at any time.
We may change subscription pricing. For existing subscribers, price increases take effect only after the notice and consent process required by Apple and applicable law, and never retroactively for a period already paid for.
The App, including all content, features, software, design, graphics, logos, and underlying technology, is owned by the Developer and protected by copyright, trademark, and other intellectual property laws. "Shade" and associated logos are trademarks of the Developer and may not be used without prior written permission. UV and weather data are provided by Apple WeatherKit and are subject to Apple's terms.
SHADE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The UV index, forecasts, and protection suggestions are for general informational purposes only and are not a substitute for professional medical or dermatological advice, diagnosis, or treatment.
UV data is an estimate and may be inaccurate or delayed. Following the App's suggestions does not guarantee protection from sunburn, skin damage, or skin cancer. Always use appropriate sun protection and follow the guidance of qualified professionals.
Always seek the advice of a qualified healthcare provider regarding skin health, moles, or any medical condition. Never disregard professional medical advice because of content in this App. If you have a medical emergency, contact your local emergency services immediately.
TO THE MAXIMUM EXTENT PERMITTED BY LAW (SUBJECT TO MANDATORY CONSUMER PROTECTION LAWS FOR EU CONSUMERS), THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THE ACCURACY OR RELIABILITY OF UV/WEATHER DATA OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
EU Consumer Notice: If you are an EU consumer, this disclaimer does not affect your statutory rights, including rights to conformity of digital content and services under Directive (EU) 2019/770.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable consumer protection law.
Subject to Section 10.1, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
Subject to Section 10.1, our total liability for all claims relating to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred euros (€100.00).
The App relies on third-party services including Apple (WeatherKit, App Store, StoreKit) and PostHog. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of them is governed by their respective terms and privacy policies.
We may modify, suspend, or discontinue the App (or any part of it) at any time. We may also revise these Terms from time to time; the "Last Updated" date indicates the latest revision. Material changes will be notified through the App or by email where provided. Continued use after changes become effective constitutes acceptance.
You may stop using the App and delete it at any time. Deleting the App does not cancel paid subscriptions — you must cancel through your App Store account. We may suspend or terminate your access if you breach these Terms. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.
Because the App is distributed through Apple's App Store, you acknowledge that: these Terms are between you and the Developer, not Apple; Apple has no obligation to provide maintenance or support for the App; Apple is not responsible for any claims relating to the App; and Apple is a third-party beneficiary of these Terms and may enforce them against you.
These Terms are governed by the laws of [Country — e.g. Germany], without regard to conflict-of-laws rules, and subject to the mandatory consumer protection laws of your country of residence.
If you submit feedback or suggestions, we may use them without restriction or compensation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback into our products and services.
BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE, YOU MUST NOT USE THE APP.
